Evan Weinstein was published in the Family Law special section of the New Jersey Law Journal on July 6, 2020 in an analysis article entitled “COVID-19 Is the Immediate Change of Circumstances” about the issue of modification of support obligations for both child support and alimony in the uncertain times of the COVID-19 pandemic. Evan discussed that prior to the COVID-19 outbreak, modification of support was often a complicated and intense battle for both sides.
Evan examines the fairness and efficacy of modification rules pre-pandemic, in which immediate changes to income were considered temporary in nature and would not trigger an immediate modification of support to the current situation. He asks whether it is still necessary for courts to still conduct a plenary hearing for a resolution, or should there be a different standard that deviates from that requirement. Specifically, he raises that COVID-19 is an immediate change of circumstances that in many cases may necessitate a Court to determine that a modification of support without a plenary hearing is appropriate.
